1. Overview and Nature of Our Service
Talkivist provides AI-powered language learning services delivered exclusively as digital content via the internet. Our platform constitutes "digital content not supplied on a tangible medium" within the meaning of EU Directive 2011/83/EU on Consumer Rights.
Because our services are digital in nature and are made immediately available upon purchase, specific rules apply regarding the right of withdrawal. We are committed to transparency and fairness, and this policy is designed to reflect both your consumer rights and the practical realities of digital content delivery.
2. EU Right of Withdrawal — Digital Content Exception
Under Article 9 of EU Directive 2011/83/EU, consumers generally have a 14-day right of withdrawal from distance contracts. However, under Article 16(m) of the same Directive, this right of withdrawal does not apply to digital content not supplied on a tangible medium once performance has begun, provided that:
- The consumer has given prior express consent to begin performance before the end of the 14-day withdrawal period; and
- The consumer has acknowledged that they thereby lose their right of withdrawal.
By completing a purchase on Talkivist and accessing the platform, you expressly consent to the immediate commencement of digital content delivery and acknowledge that you lose your right of withdrawal upon first use of the service (i.e., upon starting your first AI conversation session).
3. Refund Eligibility — Session-Based Rule
Our refund eligibility is determined by whether the digital content has been accessed and used:
Eligible for Refund — No Sessions Used
If you have purchased a subscription but have not yet started any AI conversation session, you may request a full refund within 14 calendar days of your purchase date. In this case, the digital content has not been accessed and the right of withdrawal remains intact.
- Request must be submitted within 14 days of the original purchase date
- Your account must show zero completed or in-progress AI sessions
- Applies to first-time subscriptions only (not renewals)
- Request must be made by the account holder via email to info@talkivist.me
Not Eligible for Refund — Sessions Have Been Used
Once you have started one or more AI conversation sessions — regardless of the number of sessions completed or the time elapsed since purchase — the digital content is considered accessed and delivered. In accordance with Article 16(m) of EU Directive 2011/83/EU, the right of withdrawal no longer applies.
This applies whether you have completed one session, several sessions, or used the platform in any capacity. The act of beginning a session constitutes use of the digital content, and no refund will be issued on this basis.
4. Subscription Renewals
Talkivist subscriptions renew automatically at the end of each billing period. Regarding renewal charges:
- Renewal charges are non-refundable once the new billing period has commenced
- You may cancel your subscription at any time before the renewal date to avoid future charges
- We send a renewal reminder email at least 7 days before each billing date
- If you were charged due to a confirmed technical error or system malfunction, contact us within 48 hours for a full review
5. Exceptional Refund Circumstances
Outside of the eligibility window described in Section 3, refunds may be considered at our discretion in the following exceptional circumstances:
- Significant and documented technical failures that prevented access to the service for more than 72 consecutive hours
- Duplicate charges resulting from a confirmed billing system error
- Unauthorised charges where account compromise is confirmed and reported promptly
- Service discontinuation by Talkivist — in which case a pro-rata refund for the unused prepaid period will be issued
6. Non-Refundable Situations
Refunds will not be issued in the following situations:
- Any subscription where one or more AI conversation sessions have been started or completed — the digital content has been accessed and delivered
- Requests made after the 14-day window for subscriptions where no sessions were used
- Subscription renewals where the billing period has already commenced
- Accounts suspended or terminated due to violations of our Terms of Use
- Dissatisfaction with AI-generated content, learning outcomes, or subjective experience of the service
- Failure to cancel before a renewal date when reminder notifications were sent
- Promotional or discounted subscriptions unless otherwise stated at the time of purchase
7. How to Request a Refund
To request a refund, please follow these steps:

Provide Details
Include your registered email address, the date of purchase, your subscription plan, and confirmation that no sessions have been started.
Review Process
Our team will verify your session history and review your request within 3 business days.
Refund Processing
Approved refunds are processed within 5–10 business days and returned to the original payment method used at purchase.
8. Chargebacks and Disputes
We strongly encourage you to contact us directly before initiating a chargeback with your bank or payment provider. We are committed to resolving disputes fairly and promptly. Initiating a chargeback without first contacting us may result in:
- Immediate suspension of your Talkivist account pending investigation
- Permanent account termination if the chargeback is found to be unwarranted
- Reporting to fraud prevention services where applicable
If you believe a charge was made in error, please contact us at info@talkivist.me and we will investigate promptly.
9. Currency and Payment Method
All refunds are issued in the same currency as the original transaction and to the original payment method. We are not responsible for currency conversion fees or exchange rate differences between the time of purchase and the time of refund. Processing times may vary depending on your bank or card issuer.
10. Your Statutory Consumer Rights
Nothing in this Refund Policy limits or excludes your statutory rights as a consumer under applicable law. If you are located in the European Union, your rights under EU consumer protection law — including Directive 2011/83/EU — are fully respected. The digital content exception under Article 16(m) applies only where you have expressly consented to immediate performance and acknowledged the loss of withdrawal rights, as confirmed at the time of purchase.
